Does the State take our assets if we do not have a Will?

If you pass away without a valid Will your estate (your assets) will only go to the Crown (the State) if you pass away and you do not have any of the following surviving relatives: spouse or domestic partner; children; grandchildren; parents; siblings; grandparents; aunts and uncles; or cousins. 

If you pass away without a Will the administration of your estate will likely be a more expensive process as there is usually more work involved. 

If you pass away without a valid Will, the Administration and Probate Act 1919 (South Australia) sets out who will be entitled to administer and inherit your estate. This varies depending on how the Act applies to your particular circumstances.
